1. Mandatory Ignition Interlock Devices (IID) for DUI Offenders
AB 366:
Starting January 1, 2026, California extended and expanded its ignition interlock device program for people convicted of DUI.
All DUI offenders may be required to install an Ignition Interlock Device (IID) in any vehicle they drive.
An IID is a breath-test device that prevents the car from starting if alcohol is detected.
The program is extended through January 1, 2033.
Key points:
This expands coverage beyond repeat offenders and certain injury-involved DUI cases to include many, potentially first-time, DUI convictions.
Non-compliance (failing to install or use the IID as required) can lead to fines up to $5,000, jail time up to 6 months, or both.
Note: The precise circumstances where an IID is mandatory can depend on case specifics and court orders (and AB 1546 is currently being considered for further DUI sentencing reform). For guidance about your situation, contact me for a free consultation.
2. Longer Probation for DUI-Related Vehicular Manslaughter
AB 1087
Starting January 1, 2026, if someone is convicted of vehicular manslaughter while intoxicated or gross vehicular manslaughter while intoxicated, the probation period has increased.
Probation used to be 2 years. Now it’s 3 to 5 years.
Key points:
Longer supervision by probation officers
More conditions and monitoring
Potential jail time for violations under extended probation
3. Other DUI / Driver-Safety-Related Updates
While not strictly DUI penalties, several other 2026 traffic laws can affect drivers and enforcement environments:
Expanded Automated Enforcement
Local governments may use cameras for red light enforcement and other traffic violations (SB 720). These are civil violations but can result in fines even without police present.
“Move Over / Slow Down” Law Expansion
Drivers must now slow down and safely change lanes for any stationary vehicle with hazard lights on the roadway (not just CHP/Caltrans vehicles).
License Plate Tampering Penalties
It’s now an infraction with up to $1,000 fines for manufacturing or selling devices that obscure or
Other Notes Relevant to DUI & Driving
BAC (blood alcohol concentration) legal limits have not changed:
0.08% for regular drivers
0.04% for commercial drivers
0.01% for drivers under 21
Important Practical Impact
More sobriety enforcement tech: IIDs are now a key part of DUI sentencing and license reinstatement.
Longer probation for serious/intoxicated crashes: Increased oversight after intoxicated manslaughter convictions.
Traffic enforcement modernization: Automated systems and lane/slow rules aim to reduce collisions and unsafe behavior.
The laws for drivers under the influence of alcohol and drugs are getting more strict and punishing. It is so important that you contact an experienced and compassionate lawyer as soon as possible.
The process after getting charged with a DUI has many steps. You must deal with the DMV and their administrative hearing, get your license back, mitigate damages, and deal with prosecutors and judges.
